Therefore CIVITATIS IS LIMITED EXCLUSIVELY TO THE BOOKING OF ACTIVITIES, EXCURSIONS, GUIDED TOURS AND TRANSFERS, THROUGHOUT THE WORLD, WHICH ARE CARRIED OUT DIRECTLY BY THE SUPPLIERS.

In addition, through the Website, GOTRANSFERTAXI offers its Users free travel guides to different destinations, which include photographs, information on transportation, the most important tourist places, an interactive map and different recommendations and advice related to the destination. The User must keep in mind that this receipt is not equivalent to the corresponding invoice for contracting these services. The User can download documentation related to the contracting of services by CIVITATIS through the Website. In some cases the documentation necessary to contract this service will be sent via email to the User by the provider. If the contracted service is performed outside of Spain, CIVITATIS will send a purchase receipt and Users may request an invoice from the supplier.

10.- PRODUCT LIABILITY

Without prejudice to the liability in package travel services that are subject to the provisions of the General Law of Consumers and Users, and by way of example but not limitation, GOTRANSFERTAXI is not responsible for the following circumstances:

  • Users who cancel a service outside the deadline. GOTRANSFERTAXI is not responsible under any circumstances for returning the amount paid by Users when they have not complied with the cancellation period stipulated in the cancellation policy applied to each service.
  • When the User arrives late at the activity meeting point on the day of the activity (booked guided tour, day trip and/or transfer). This means that GOTRANSFERTAXI will not assume any responsibility if the User arrives late for the activity or misses their transfer due to delay and/or not finding the correct meeting point.
  • When local providers refuse the User an activity, excursion and/or guided tour because the User does not provide the corresponding voucher, either printed or downloaded to their smartphone (depending on the Provider’s requirements).
  • When Users’ property is damaged or stolen during the activity, day trip, booked guided tour or during the booked transfer service.
  • When the User suffers an accident, injury or any type of damage during the activity, excursion, guided tour and/or transfer service. Likewise, Users who suffer an accident or injury before the day of the activity and which prevents them from enjoying the contracted service.
  • When the transfer service does not arrive at the meeting point because the information provided by the User is incorrect or erroneous regarding time and address.
  • When the User misses their flights, trains, buses or any other means of transportation, as a result of not having booked the transfer service sufficiently in advance, as recommended by GOTRANSFERTAXI. It is the user’s responsibility to know their departure time (flight/train/bus) and to reserve the corresponding transfer service well in advance.
  • Due to the weather conditions in which the local provider carries out the activities, excursions and guided tours reserved by Users. In no case is GOTRANSFERTAXI responsible for these circumstances, in which case it will be understood that the service has been performed correctly.
  •  Due to the quality of the service provided by the local provider.
  • For situations in which the activities, excursions or guided tours have been carried out visiting the main points of interest, but the duration has changed a little due to any factor beyond the control of the provider and/or GOTRANSFERTAXI. In this situation, the service will be considered performed correctly.
  • For claims and refunds regarding the service contracted by the User that is the responsibility of the Collaborator, without taking into account that GOTRANSFERTAXI may collaborate with the User to attend to their refund.

Likewise, and in the event that the User contracts the services directly with the Provider, GOTRANSFERTAXI will not be responsible for:

  • The fulfillment of any obligation, whether financial or otherwise, as a consequence of the service provided by the Collaborator. GOTRANSFERTAXI is not responsible for any type of financial obligation in relation to the services provided.

Likewise, in no case is GOTRANSFERTAXI responsible or offering any guarantee for any type of damage caused by access or use of the Contents or the Website. GOTRANSFERTAXI is not responsible for the following circumstances:

  • If the Website and/or its services or Contents are unavailable, under maintenance or used incorrectly, excluding, to the maximum extent permitted by current legislation, any liability for damages that may be related to the lack of availability or continuity of the Website and its enabled Content.

However, if the User books additional travel services during the same visit on the CIVITATIS Reservations Website, these services will form part of the linked travel services. In this case, as required by European Union legislation, CIVITATIS has signed a protection guarantee to reimburse the User for payments made to CIVITATIS for services not provided due to the insolvency of CIVITATIS and, where applicable, for repatriation. Please note that no refund will be made in the event of the insolvency of the relevant service provider.

11.- INTELLECTUAL PROPERTY
